This is really a formidable international obligation and a testing challenge to the developing countries especially which cannot be met without the cooperation and help of the developed countries. So the developing countries, particularly African and South Asian countries, should take this task seriously and should pull up their sleeves to take their health care commitment critically. These countries should strive to translate the international human right to health care into an enforceable basic human need in their national jurisdictions by appropriate constitutional and legislative measures so that the right may not remain a distant mirage. The right to health care, as an international human right, is founded on the edifice of the prescriptions of the United Nations Charter, the International Bill of Rights, the Convention on Elimination of All Forms of Discrimination Against Women, 1979, the United Nations Convention on the Rights of the Child, 1989, etc. There fore the members of the international community are expected to build their health care strategies on this edifice. United Nations Charter The United Nations Charter does not expressly provides for the provisions for health care. The Charter declares that the promotion of respect for human rights and fundamental freedoms for all without distinctions based on race, sex, language or religion is one of its fundamental purposes of the establishment of the United Nations Organization.[2] To achieve this purpose, the United Nations is charged with the responsibility to promote, interalia, higher standards of living, full employment, conditions of economic and social progress and development, and solutions of international economic, social, health and related problems.[3] In similar vein, the member states are obliged to pledge themselves to take joint and separate action in cooperation with the United Nations Organization for the achievement of the declared purposes.[4] Thus, the Un ited Nations which is charged with the promotion of respect for human rights has to function through the General Assembly which is entrusted with this function.[5] It is an accepted fact that the resolutions of the General Assembly are not at all legally binding on the member countries. Consequently, many member states have not thought it appropriate and necessary to respect and observe human rights in their national jurisdictions. Nevertheless, the international legal obligation to promote respect for, and observance of, human rights, as enshrined in the United Nations Charter is significant in one sense, for, it serves to remove the subject of human rights from the exclusive domestic domain and to transform it into a subject of international concern.[6] This has paved the way for the adoption of not only the Universal Declaration of Human Rights by the United Nations General Assembly but also the conclusion of various international multilateral human rights instruments by the U.N. as well its specialised agencies and various regional inter-governmental organizations. The Universal Declaration of Human Rights Ever since the adoption by the world community of the Universal Declaration of Human Rights, 1948. Public disclosures relating to health have been conducted in the language of rights on the assumption that the State has definite obligations in the maintenance of public health, that is, conditions in which people can live healthy. The adoption of the UDHR by the U.N. General Assembly revolutionized the human rights in the world, thereby marking the ushering in of a new era in the mankindà ¢Ã¢â€š ¬Ã¢â€ž ¢s struggle for freedom and human dignity. The Declaration proclaims that all human beings are born free and equal in dignity and rights[7] and that they are entitled to a social and international order in which the rights and freedoms are set forth in this Declaration can be fully realised.[8] A significant feature of the UDHR is that it proclaims a nd recognizes the importance of not only civil and political rights but also economic, social and cultural rights. Of these, individual rights to social security, to work, to protection against unemployment, to rest and leisure and to protection against torture and cruel and inhuman treatment are some of the important rights the enjoyment of which depends on the efficacy of the right to health and health care. Coming to the crucial provision of the Declaration which expressly recognises the right to health, Article 25 reads: à ¢Ã¢â€š ¬Ã…“1. Everyone has the right to a standard of living adequate for the health and wellbeing of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control. 2. Motherhood and childhood are entitled to special care and assistance. All child ren, whether born in or out of wedlock, shall enjoy the same social protection.à ¢Ã¢â€š ¬Ã‚  The rights proclaimed by the Declaration are not absolute as they are subject to the authority of the member states to enact laws limiting the exercise of these solely for the purpose of securing à ¢Ã¢â€š ¬Ã…“due recognition and respect for the rights and freedoms of others and of meeting the just requirements for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.à ¢Ã¢â€š ¬Ã‚ [9] It may be appreciated that while the Declaration proclaims that all members of the society are entitles to the realisation of the economic, social and cultural rights which are indispensable for enjoyment of manà ¢Ã¢â€š ¬Ã¢â€ž ¢s dignity and development of his personality, their actual realisation has been made dependent on the availability of resources at the disposal of the member states. The International Bill of Human Rights Ever since the adoption by the world community of the Universal Declaration of Human Rights, 1948, public disclosures relating to health have been conducted in the language of rights on the assumption that the State has definite obligations in the maintenance of public health, that is, conditions in which people can live healthy. In 1996, the international community articulated the right in Article 12 of the International Covenant on Cultural, Economic and Social Rights in the following terms: à ¢Ã¢â€š ¬Ã…“1. The Stateà ¢Ã¢â€š ¬Ã¢â€ž ¢s Parties to the present Covenant recognize the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. 2. The steps to be taken by the Stateà ¢Ã¢â€š ¬Ã¢â€ž ¢s parties to the present Covenant to achieve the full realisation of this right shall include those necessary for: (a) The provision for the reduction o f the still birth rate and of infant mortality and for the healthy development of then child; (b) The improvement of all aspects of environmental and industrial hygiene; (c) The prevention, treatment and control of epidemic, endemic, occupational and other diseases; (d) The creation of conditions which would assure to all medical service and medical attention in the event of sickness.à ¢Ã¢â€š ¬Ã‚  Article 12 of the ICESCR forms a base of right to health. The article recognizes the right of everyone to enjoy the highest standard of physical and mental health. It enumerates four steps to be followed by the State so that everyone can realize the right to health. It states that States must act to enhance the welfare of children in general, such as reduction in still birth rate and infant mortality and health development of the child. States must take measures to improve environment and industrial hygiene, must prevent and treat epidemic, endemic, occupational and other dis eases. States must also strive to optimize health service. Here also the multi-form nature of heath carves a coherent whole in the text of the covenant. Right to health is a means of attaining full development of the right to life and integrity of human person, a means of recognizing right of each individual to what the community owes him, and a means of creating duties under State responsibility to contribute to the satisfaction of the individual aspirations of citizens. A close scrutiny of the measure that the State has to undertake reveals several areas. However, the criticism is often overcome by a counter argument that since human rights treaties are of a law-making character as opposed to contracting treaty, they purport to give fuller effectiveness to their guarantee and hence it is essential that wide ranging and socially evolving, matters affecting health be economic passed within article 12.[10] Although the International Covenants on Human Rights were adopted in 1966, they came into force only in 1976. The instruments were designed to transform the principles proclaimed in the Declaration into binding treaty obligations. Not all states are parties to these Covenants. While the Covenant on Civil and Political Rights incorporate mainly the à ¢Ã¢â€š ¬Ã…“first generationà ¢Ã¢â€š ¬Ã‚  classical human rights which are negative in nature, imposing only negative obligations on the stateà ¢Ã¢â€š ¬Ã¢â€ž ¢s parties, the Covenant on Economic, Social and Cultural Rights which is more relevant in the context of present discussion embodies the à ¢Ã¢â€š ¬Ã…“second generationà ¢Ã¢â€š ¬Ã‚  human rights which are positive in scope and character, imposing positive and affirmative obligations on the stateà ¢Ã¢â€š ¬Ã¢â€ž ¢s parties.[11] The Covenant also enumerates several other rights which have a bearing on the right to health and health care. The theoretical division between civil and political rights and economic, social and cultural rights has defi nitely an impact on the nature of right to health. At the outset in contrast to ICCPR, the ICESCR is not immediately binding but subordinated to the principle of progressive realization. This means that treaty provisions are intended to acquire full realization of right only progressively to the maximum of its available resources. From the perspective of right to health this means that realization of the same depends upon resources of the State. So the main drawback of this type of language is that it may be used as a shield by the State to evade responsibilities in ensuring right to health. However, it has been cautioned by the committee on economic, social and cultural rights that the fact that realization overtime or in other words progressively should not be misinterpreted as depriving the obligation of all meaningful content. It is just a flexible tone reflecting realities of the real world and the cultural rights. But as a matter of fact the caution has always been ignored by the States.[12] Another weakness inherent in ICESCR is the nature of language. While ICCPR provisions are formulated in an affirmative and unconditional way such as à ¢Ã¢â€š ¬Ã…“Everyone shall have the rightà ¢Ã¢â€š ¬Ã‚ . ICESCR provisions state only that à ¢Ã¢â€š ¬Ã…“State parties recognize or undertake to ensureà ¢Ã¢â€š ¬Ã‚ . The terms like à ¢Ã¢â€š ¬Ã‹Å"recognizeà ¢Ã¢â€š ¬Ã¢â€ž ¢, à ¢Ã¢â€š ¬Ã‹Å"undertake to ensureà ¢Ã¢â€š ¬Ã¢â€ž ¢ were chosen deliberately to lessen the operative force of the provisions and to entrust to States a broader ambit of discretion. Again another important deficiency of ICESCR is that as compared to general clause in Article 2 of ICCPR there is no explicit reference to judicial or other forms of remedy.[13] There is no individual or inter State complaint mechanism as with the operative clause under the ICCPR and its first optional protocol. The State parties to the ICESCR are only required to submit reports to the committee on economic, s ocial and cultural rights on any national legislative and other measures taken to give fuller effect to the right guaranteed in ICESCR. While the Covenant on Civil and Political Rights creates immediate negative legal obligations on the state parties, the Covenant on Economic, Social and Cultural Rights only requires a progressive implementation of positive obligations by the state parties within the scope of their available resources. The Covenant requires each state party to take positive steps to the maximum of its available resources, with a view to achieving progressively the full realization of the rights by all appropriate means, including particularly the adoption of legislative measures. Courtesy of Roger Williams University Archives.ROGER WILLIAMS was born in London, circa 1604, the son of James and Alice (Pemberton) Williams. James, the son of Mark and Agnes (Audley) Williams was a merchant Tailor (an importer and trader) and probably a man of some importance. His will, proved 19 November 1621, left, in addition to bequests to his loving wife, Alice, to his sons, Sydrach, Roger and Robert, and to his daughter Catherine, money and bread to the poor in various sections of London. The will of Alice (Pemberton) Williams was admitted to probate 26 January 1634. Among other bequests, she left the sum of Ten Pounds yearly for twenty years to her son, Roger Williams, now beyond the seas. She further provided that if Roger predeceased her, what remaineth thereof unpaid shall be paid to his wife and daughter. Obviously, by the time of her death, Rogers mother was aware of the birth in America in 1633 of her grandchild, Mary Williams. Rogers youth was spent in the parish of St. Sepulchres, without Newgate, London. While a young man, he must have been aware of the numerous burnings at the stake that had taken place at nearby Smithfield of so-called Puritans or heretics. This probably influenced his later strong beliefs in civic and religious liberty. During his teens, Roger Williams came to the attention of Sir Edward Coke, a brilliant lawyer and one-time Chief Justice of England, through whose influence he was enrolled at Suttons Hospital, a part of Charter House, a school in London. He next entered Pembroke College at Cambridge University from which he graduated in 1627. All of the literature currently available at Pembroke to prospective students mentions Roger Williams, his part in the Reformation, and his founding of the Colony of Rhode Island. At Pembroke, he was one of eight granted scholarships based on excellence in Latin, Greek and Hebrew. Pembroke College in Providence, once the womens college of Brown University, was named after Pembroke at Cambridge in honor of Roger Williams. In the years after he left Cambridge, Roger Williams was Chaplain to a wealthy family, and on 15 December 1629, he married MARY BARNARD at the Church of High Laver, Essex, England. Even at this time, he became a controversial figure because of his ideas on freedom of worship. And so, in 1630, ten years after the Pilgrims landed at Plymouth, Roger thought it expedient to leave England. He arrived, with Mary, on 5 February 1631 at Boston in the Massachusetts Bay Colony. Their passage was aboard the ship Lyon (Lion). He preached first at Salem, then at Plymouth, then back to Salem, always at odds with the structured Puritans. When he was about to be deported back to England, Roger fled southwest out of the Massachusetts Bay Colony, was befriended by local Indians and eventually settled at the headwaters of what is now Narragansett Bay, after he learned that his first settlement on the east bank of the Seekonk River was within the boundaries of the Plymouth Colony. Roger purchased land from the Narragansett Chiefs, Canonicus and Miantonomi and named his settlement Providence in thanks to God. The original deed remains in the Archives of the City of Providence. Roger Williams made two trips back to England during his lifetime. During this voyage, he produced his best-known literary work Key into the Languages of America, which when published in London in 1643, made him the authority on American Indians. On his return, Roger Williams started a trading post at Cocumscussoc (now North Kingstown) where he traded with the Indians and was known for his peacemaking between the neighboring colonists and the Indians. You’re not only getting your-self situated as far as classes go, but also meeting new people. You have to balance all the new tasks in your life as well as starting new relationships. One obvious cause of wanting to become a student-athlete is the persona. Everyone wants to be the star athlete and everyone wants to be the cool kid on the sports team that gets all the chicks. This is something that we were raised around, all the professional athletes getting praised as kings while walking around with a supermodel around their arm. I mean who wouldn’t want that kind of life? Being a student-athlete is something that you can take pride in. You want to take pride in yourself by representing your team in athletics but also want to further your education by acquiring a degree witch causes you to be a student athlete. It also makes you stand out among the rest because not only are you a full time student but also a full time athlete. Which gives you life skills like motivation and determination that you take with you through out life. Sure being a student-athlete teaches you how to balance a crazy life style and creates better time management but it also allows you to create great friendships. The first effect of a student-athlete is that you will develop physical abilities. The second effect has to do with your personal life. Practicing a sport requires some time, plus schoolwork and everything else going in your life you usually don’t have time to lie around and be lazy. There is only a fortunate bunch of people that get to put on a uniform to represent something bigger than them, so as a student-athlete you take pride in what you do, and you take advantage in representing your school every time you touch the field. The most important effect of being a student athlete is your teammates and your everlasting friendships. You will meet a lot of people being a student-athlete but only a small group of individuals will become your friends to the point you can call them your second family. That is the meaning of a team. As an athlete you will develop a strong character and a competitive spirit. You’ll become more disciplined and responsible, which will certainly help you in your professional life. Above all you develop relationships that can be unbreakable. You go through hell with each other, or as some people like to call it conditioning. You step on the field and go to battle with one another trusting that the other guys in the game will give as much effort if not more to win. You’ll get on each other’s nervous and sometimes get into fights, but no matter what at the end of the day you’ll always have your second family. The effect of being a student-athlete shapes your body, your life, and your mind in good ways. Practicing a sport, going to classes, doing homework and trying to balance a social life keeps you entertained and far away from boredom. In addition you will have the chance to experience the amazing feeling of success after all the hard work you put in to being a student-athlete. It’s worth all the early morning practices, and tough love conditioning to be able to see defeat in your opponents face. It’s worth all the seven o’clock classes, and professors’ monotone lectures to be able to see the overwhelming sense of joy on your mothers face as you receive you diploma. It’s worth the long bus rides, and all the tough losses to be able to have a group of guys you can call you’re family. Even though its hard work being a student-athlete is a great experience that will stay with you forever.

September 11: An American Victory The terrorist attack on the World Trade Center and Washington DC has been described as an act of war and a tremendous defeat for the United States, a defeat that must not be allowed to be repeated and a loss that must be avenged. Personally, I don't like the use of the phrase "Act of War". Wars are something that happen between states. Wars end when one side surrenders. If we treat this as a literal war, what will be the victory conditions? Who will surrender? How will we know that the war is over? Whose suit for peace will be listened to? But, for the sake of discussion, let us ignore these concerns, let us concede for the nonce that the language of war is appropriate. Let us put aside the questions of who exactly the enemy is. We know, at least, who 19 of the other side's foot soldiers were. We know, more or less what happened. I'm willing to set these questions aside because I have become angry, angry about how we ourselves are viewing the outcome of this attack, and how we are letting the world view it. I am angry about how we are viewing the acts of heroes, and how we are view ourselves as a nation. Let me state this quite clearly...   The United States did not lose the Battle of September 11, 2001. Claiming that we did diminishes the heroism that Americans showed. It underestimates American strength and it misses some very important points about the American character. There were four phases of the battle, four attacks. The first two took us completely by surprise, and can easily be viewed as a two pronged attack. Two transcontinental planes flying from Boston were turned into bombs and used to destroy the twin towers of the World Trade Center. Because they had the element of surprise the enemy's first thrust was extremely effective. The battle started very badly for us. The third phase occurred in Washington DC. The enemy hijacked a third commercial airliner. This time, however, US intelligence and technology began to come into play. At least one passenger was able to contact the Justice Department, inform them of what was happening and ask what instructions should be passed to the pilot. I'm speaking here, of course, of Barbara Olson's phone call to the Solicitor General, her husband Ted.

Charles Mingus Use of Bass Guitar

Charles Mingus, a man who had made many contributions to the jazz world, which had included the introduction of the stand-up-bass as a lead instrument where it normally was used to keep time. He is known for composing the second largest amount of pieces just second to Duke Ellington2. He had mainly focused on collective organization when writing is charts that were similar to old school New Orleans street jazz bands, and his peers had once called him an organizational genius for this.Mingus’s pieces are known to be very temperamental meaning the music would go from very loud at times, to soft soothing sections, which got him the nickname â€Å"the angry man of jazz†. Mingus was born on April 22nd, 1922 and raised in Watts, California to a very religious family1. He had started out his musical career by learning to play the piano from his mother, which led him to playing at his local church1 as his musical wisdom began to expand. For most of his childhood he was only alo ud to listen to worship music, seeing how at the time since jazz was viewed as music of the devil due to its association with booze, and drugs.But at times he would sneak away from his studies in religious music and listen to his idol the world renowned Duke Ellington. He made his transition from the piano to the standup bass when he moved to New York and studied with H. Rheinhagen and the principal bassist Lloyd Reese from the New York Philharmonic School1. Mingus’s music was a mixture of Avant-Garde with an incorporation of Gospel, which left him room for breakthroughs in his music. During the 1940s, when Mingus had made the most progress in his work he had wrote such works that were covered by Lionel Hampton, specifically the album Mingus Fingers.In that album Mingus had used the bass as a lead instrument. People during this time period found it strange that a bass took lead, since it was standard for the bass to keep time, but Mingus revolutionized it with his ability to improvise within his solos, which he learned from Ornette Coleman. An excellent example of this would be his soloing in the song â€Å"Goodbye Pork Pie Hat†. Lester Young had inspired Mingus to record this song since their sounds were so different from each other’s. Despite his success he still minimal reviews from his record company and was not making nough money to support himself. Towards the beginning of the early 50s Mingus had migrated east to New York City to pursue a career to help make him some money to live on. He became a postal worker delivering mail in 1949 and through this job he met what would be his long time drummer Max Roach. Mingus had scored his first concert since his move from L. A. In 1952 Roach scored a gig at Massey Hall in Toronto where many of the greats would be playing such as Dizzy Gillespie, Charlie Parker, Bud Powell and Roach himself.This jumpstarted Mingus’s career again and segued him into bebop. Although Mingus viewed bebop as a very straight forward beat (from a bassists perspective) and didn’t like the thought of playing such a simple beat when asked to solo like most bassists of the time which was described as a â€Å"boom boom boom†¦Ã¢â‚¬ 4 feel to it, this is where he developed the usage of playing with three fingers instead of the customary two3 which became part of his signature sound.Mingus’s masterwork, which is called â€Å"Epitaph†, would take two hours to perform with the 4000 measures that it covered over the course of time. This work of art was discovered while his music was being processed into CD’s at the time3. Even the New York Times had marked it as the most memorable of jazz pieces of all time5. His chart was also known as the best composition since the times of Duke Ellington making him again even more like his idol3.When the music had finally come to and end on January 5, 1979 when Mingus passed away he had left this world with many new sounds for us to appreciate and to learn from. His sound had changed as he aged and so did his style to adapt to the times. He had revolutionized an instrument at one point only thought to keep time and he added the idea of playing with more than two fingers paving the way for many new bass players to learn from. Mingus was in fact an extraordinary musician and had ever-changed jazz for the better.
